What is mediation's place?

How does mediation fit into a system of justice that seems antithetical to mediation? What changes need to be made to court procedures, and to litigants' mindsets, to allow issues to be resolved by negotiation instead of by litigation? Should we stop thinking of mediation as "alternative" dispute resolution? What makes mediation work?

These are a few of the questions I am interested in exploring in this blog. As a trial attorney practicing for more than 30 years, I noticed a long time ago that the vast majority of my cases ended by negotiated settlement. Are there better ways of getting to that result?
